Dear lokesh,

Thanking for your New Year Wishes. I have seen you yesterday venting out
your anger before the media on the NOIDA case. I feel that the NOIDA area
should start Social Policing. Thsi is not a isolated episode.
Kidnapping,ransom, rape and brutality is looming large over NOIDA. Unless we
create a matrix of harmony and belief among the poor and so called rich in
the society this sort of massacre wil be continued. I would request you to
submit a RTI on the crime report and Final report of ecah case of that area
for the last 5 years.

The good

Here's something to reinforce faith in our babudom: Transpar-ency International has complimented India for improving its ranking from 88 to 70. Government has become more transparent: Thanks to increasing use of e-governance to announce tenders for public procurement and the introduction of the Right to Information Act.

These have made it more difficult — albeit not impossible — for officials to mask biased decision-making.

Also, there have been attempts at reform: Starting from Ricketts' report on civil establishments and salaries in 1866 to Veerappa Moily's 2005 report, Unlocking human capital: Entitlement and Governance, there has been no dearth of blueprints.

The bad

Despite the Centre and states spending Rs 3,000 crore a year on initiatives to make administration faster and transparent, 75% respondents in a Transparency India survey said corruption has increased in the last year; 62% said corruption is not hearsay but a fact of our lives.

India's 2 million babus — out of a workforce of 19 million government employees — often obstruct, rather than serve public good.

Common people pay an estimated Rs 21,000 crore a year in petty bribes for 11 most-used services like the police, judiciary, land, municipal and health.

In fact, a UNDP report says if corruption came down to Scandinavian levels, growth would jump 1.5% and FDI by 12%.

The police is seen as most corrupt, followed by the judiciary. In 2005, chargesheet rate for homicide was 85%, but 40% cases were pending investigation.

In the same year, conviction rate for murders was 35%. Overall, conviction rate in IPC cases has declined from 64.8% in 1961 to 42.4% in 2005. As many as 144 police custodial deaths (out of 359 in the past three years) were reported in 2005, but few cops have even been charged.

Our food subsidy schemes are a perfect illustration of bureaucratic bungling: Rs 150 million is spent on PDS, which targets have-nots, including a slum population of 42,578,150 in 640 cities. But not all of the subsidy goes where it is intended: 31% of foodgrain and 36% of sugar leak into the black market.

There are 4,000 municipalities. Most don't have computerised land records, services are poor and corruption is rampant.

Though labelled an IT powerhouse, India lags way behind countries like the US and UK which are now introducing metadata, or data about data, to help index online searches.

A cover-up culture, strengthened by constitutional protection, shields government servants. A CVC list of officials against whom action has been sought numbers barely 30, and most of them are low-ranking officials.

Dehra Dun, Dec 29: Demanding a CBI probe into allegations of graft against Uttaranchal Haj Committee chairman Maulana Zahid Raza Rizvi, Muslim leaders of the state sought immediate action against him.

Following the sting operation by a private TV channel exposing corruption in allocation of seats for pilgrims by Haj officials, Chowdhary Raees Ahmed, chairman of the Uttaranchal WAKF board, met Chief Minister N D Tiwari and demanded a CBI probe into the expose.

"We want immediate action against Rizvi," he told reporters here.

BSP leader Haji Bulland Ahmed criticised the Chief Minister for "installing corrupt leaders in top posts".

BJP spokesman D Bhasin also demanded a CBI probe into the corruption charges against Rizvi. (Agencies)

SOCIAL activist Anna Hazare on Monday said he was postponing his agitation to press the demand for effective implementation of the Right to Information Act till January 26 as his demands have been accepted in principal by Chief Minister Vilasrao Deshmukh.

In a press note, Hazare said the decision of postponing his agitation was taken after he had a meeting with Deshmukh in Mumbai on Sunday. He said the meeting was attended by Deputy Chief Minister R R Patil, Chief Information Commissioner Suresh Joshi and other senior officials.

Hazare said he was assured that by January 26, the state government would provide information on how many requisitions were required from each of the districts and what action was taken on them by the Public Information Officer (PIO).

Moreover, he said he was promised that decisions would be taken about publishing pamphlets providing information about the RTI, displaying signboards giving information about PIOs and appellate officers, appointment of four more information commissioners, providing information about functioning of every government department on websites, use of video conferencing for hearing on appeals filed under the RTI, making it mandatory for district collectors to submit report on disposal of requisitions filed under the RTI to chief information commissioner and state government every month and penal action against information officers failing to give information within the deadline or providing inadequate or false or misleading information.

Hazare has launched an agitation to press his demand under which his Bhrashtachar Virodhi Jana Andolan has been taking out morchas at offices of District Collectors across the state. Hazare had also announced that he would be going on hunger strike in Delhi from January 1 to press his demands.

NEW DELHI, JAN 3 (PTI)

The Supreme Court today directed the Government to place before it the guidelines prepared by it to regulate the expenditure of various departments on advertisements glorifying political leaders on tax payers' money.

A Bench comprising Chief Justice Y K Sabharwal and Justice C K Thakker asked the Centre to place the draft guidelines before it along with an affidavit.

The order to this effect was passed after Additional Solicitor General Gopal Subramanian told the Bench that the guidelines and rules in this regard has been prepared by the Directorate of Audio Visual and Publicity (DAVP) and Department of Expenditure.

The apex court during the earlier hearing had warned the government that if it failed to come out with the guidelines by December last, it will proceed to frame some guidelines.

The Bench, which wanted the matter to be considered by the government on priority basis, had observed "lakhs and lakhs of rupees are spent on such advertisements and there has to be some regulations and guidelines."

The court while issuing notices on July 28 last year to the Centre, states and union territories, had disapproved of advertisements with political content issued by government departments.

The order was passed on a PIL filed by advocate Manzoor Ali Khan alleging that by spending tax payers' money for private and personal benefit, "the Centre and its instrumentalities have committed not only breach of trust but it also amounts to misappropriation of public money".



The court had sought to know if the Finance Ministry had any regulations to check such expenditure by government departments on issuing advertisements in newspapers on birth and death anniversaries of political leaders.

The court had said there was a need for introspection on the issue and had cited the example of developed nations where such activities were sponsored by political parties themselves.

High Court constitutes three-member high-power commission

  • Former apex court judge to head commission
  • Commission to submit report in six months
  • KOCHI: A Division Bench of the Kerala High Court on Tuesday appointed a high-power commission to inquire into allegations of corruption and malpractice in the Travancore Devaswom Board (TDB).

    The Bench of Chief Justice V.K. Bali and Justice M. Ramachandran appointed K.S. Paripoornan, former Supreme Court judge, as chairman and B.M. Thulasidas, former Kerala High Court judge, and D.R. Karthikeyan, former Director, Central Bureau of Investigation (CBI), as members of the commission.

    The Bench ordered that the commission's report be made available to the court in six months.

    The State Government was directed to initiate proceedings for constituting the commission within six weeks.

    The directions were passed on a writ petition filed by C. Radhakrishnan and another person from Ambalappuzha seeking to appoint a high-power commission to probe allegations of corruptions in the TDB.

    The court said it would be open to the commission to examine any other issue brought before it. The court observed that the Government should ensure that sufficient persons of expertise were deputed on request to assist the commission. The commission could also inquire into accounting and auditing.

    The petitioner alleged that the TDB president, two members and the commissioner had indulged in widespread corruption in the administration of the Devaswom Board.

    Devaswom Minister G. Sudhakaran welcomed the High Court's decision to set up a commission to inquire into allegations of corruption in the TDB.

    ``We place faith in the proposed commission,'' Mr. Sudhakaran told reporters.

    He said the court's decision came at a time when the Government was thinking of recasting the structure of the Travancore and Kochi Devaswom Boards to make them corruption-free and transparent.

    AHMEDABAD: An initial audit conducted by the Comptroller and Auditor General (CAG) of India has sniffed out 'irregularities'totalling Rs 3.59 crore in SEWA's Jeevika project.

    What's more, the state government, which raked up the controversy over alleged irregularities by the self-employed Women's Association (SEWA), is sitting on CAG's observations which were submitted in November 2006.

    The CAG's observations should have been handed over to the audited party (in this case, SEWA) for reactions before the final report is made.

    However, the observations, a copy of which the TOI acquired under the Right to Information Act, have been kept away from the reputed NGO currently engaged in a spat with the government.

    "SEWA has not received any audit report either from the state government or from the CAG. We are requesting them to give preliminary report/observations/comments to us,"said SEWA's Namrata Bali in a letter to TOI.

    SEWA's spat with the Gujarat government took shape after the latter found "financial irregularities"of Rs 33.23 lakh in the NGO's Jeevika project in a special audit conducted between April and August 2005.

    This had provoked SEWA to withdraw from the project on October 11, 2005 and later, the miffed NGO also severed ties with the state government in 20 other projects.

    Vipul Mittra, commissioner of rural development, got the special audit done and then referred the matter to the CAG.

    But Mittra, who is now serving his notice per iod after having sought voluntary retirement from the Indian Administrative Service, is sitting over the matter because he does not want any fresh controversy at the end of his service. Mittra refused to comment despite numerous attempts by the TOI to contact him.

    The Rs 112.80-crore Jeevika project was launched in November 2002 to rehabilitate 400 villages of Kutch, Surendranagar and Patan districts affected in the 2001 earthquake. Partners in the seven-year project were the Government of India,Government of Gujarat and the International Fund for Agriculture Development.

    E-mails, like all correspondence in the transaction of public business, are considered public records under the Virginia Freedom of Information Act. It does not matter if the e-mail was sent from a government server or a home computer.

    The Virginia Supreme Court in 2004 ruled that e-mail correspondence in the transaction of public business is public record. The case is Beck v. Shelton.

    The Freedom of Information Act does not provide guidance about how e-mail should be preserved.
