On World Wetland Day.. two major PIL intiatives about lakes

On 2nd Feb 2009, World Wetland Day, the Hon'ble High Court of
Karnataka will hear two major PIL efforts on two high
controversial projects in Karnataka.

The High Court will hear a batch of connected PILs and Contempt
Petitions relating to the Bangalore Mysore Infrastructure
Corridor Project - a major reason for controversy being the
excessive and illegal acquisition of lands unconnected to the
project, especially about 20 lakes that have been destroyed by
M/s Nandi Infrastructure Corridor Enterprise. Former Prime
Minister Mr. Devegowda's book exposing the corruption and
collusion in the project along with his letter to Judges of the
High Court have been taken /suo moto/ as a PIL, and it should
not be a surprise to see him come personally to defend his
position. (Case No. 3568/2007, 17550/2006, etc.)

Another very important case listed for final hearing is
Environment Support Group's PIL against the privatisation of
lakes. (Case No. 817/2008)

Both matters are listed for final arguments.

Those interested in listening to the arguments may want to come
prepared for thorough searches (which will delay your entry),
and should have the cause list printed out to show at the
entrance gates to the High Court.

Invitation: Registration for the India CCM CSO Elections 2009

Greetings from the India CCM!

We would like to invite your organization to register with us for the
upcoming elections for the India-CCM of The Global Fund to fight Aids, TB &
Malaria (GFATM). It is our endeavor to encourage the broadest possible
participation in this election process to ensure that Civil Society
membership to the CCM is truly representative and is inclusive of all civil
society groups who are working to impact the course of the three diseases
HIV, Tuberculosis and Malaria in the country.

Global Fund to fight AIDS, Tuberculosis and Malaria (GFATM)
The Global Fund to fight AIDS, Tuberculosis, Malaria (GFATM) is a Global
Health Partnership set up in 2001 which is committed to dramatically
increasing funding of activities that can accelerate the reduction in
morbidity and mortality caused by HIV/AIDS, Tuberculosis and Malaria.

India Country Coordinating Mechanism (India CCM)
The India Country Coordinating Mechanism ("India-CCM") is established in
recognition of the requirements and recommendations of the GFATM.

The mandate of the India-CCM is to set priorities for country proposals to
be submitted to GFATM, take decisions on the allocation and utilization of
the Global Fund financial resources, to be involved in the selection of a
Principal Recipient (PR), guide the proposal development process, review,
endorse and submit grant proposals to the Global Fund based on priority in
the areas of addressing issues of HIV, Tuberculosis and Malaria at the
national level.

In addition, the CCM is responsible to support the implementation of
projects approved by GFATM, ensure linkages and consistency between the
GFATM assistance and other development and health assistance programs in
support of national priorities, oversee progress during implementation and
guide the Re- applying process for Phase II extension of grants.

The India-CCM has been in existence since December, 2001, and has been
successful in obtaining grants from The Global Fund, through Rounds 1, 2, 3,
4, 6 and 7. Country level provision of Anti-Retroviral Treatment (ART) for
AIDS; strengthening the Counseling and Care and Support; distribution of
insecticide treated nets for malaria; and support to battle tuberculosis
under DOTS have been made possible because of the Global Fund grants
received by the country.

India CCM Elections

The designated term (2 years) of the current voting members on the India CCM
is stipulated to end in March 2009. The revised Terms of Reference of the
India CCM has provision to host 8 Seats for members representing the Civil
Society Constituency (including NGO, CBO and faith-based organizations). It
is envisaged that the representatives be selected by the sectors themselves,
following an electronic voting process.

Civil Society Constituencies

Civil Society CCM members are expected to participate in the CCM
functioning- bringing in the civil society perspective and interests.

They are also required to further provide updates to their constituency
members who have elected them to represent on The CCM forum and represent
their views when necessary and appropriate. CCM membership requires active
participation, involvement and commitment.

Membership is forfeited by non-attendance of three consecutive CCM meetings.

The allotted Civil Society seats are for the following Sub-Sectors:

Major Public Interest Litigation initiatives on World Weltand Day

Dear Friends,

Greetings.

As the New Year rolls on into a new era of hope (thanks largely to
American voters for overhauling in one electoral stroke hundreds of
years of racial discrimination), we are happy to share with you some
very important victories in our little sphere of activity. But before we
get into the details, we wish to draw your attention to an important
clarification.

As part of its decennial celebration earlier this year, Environment
Support Group disseminated two calendars. One celebrating public spaces
was produced in house and is tied in with our ongoing campaign on
/Reclaiming Public Spaces/. Another on /Social Movements /was wholly
produced by Intercultural Resources, New Delhi, and subscribed to by us.

When we announced that these calendars are available for sale, we
inadvertently presented the Social Movements Calendar as being
co-produced by ESG. In fact, this calendar is produced entirely by
Intercultural Resources, New Delhi. We are so happy with the product
that we decided to subscribe to the effort with a small ticker at the
bottom introducing ESG - and promoting this exhaustive collation of
various peoples movements in India. We sincerely regret this error.

A few calendars (both on Social Movement and Public Spaces) are still
available us and those interested in getting a copy could soon get in
touch with us.

*Major initiatives of ESG this past month
*

ESG's campaign to ensure cities are planned and managed justly reached a
new high on 6th January 2009 when the Hon'ble Lok Adalat (Karnataka
Legal Aid Services Committee) of the Hon'ble High Court of Karnataka
heard our appeal against rampant and illegal felling of trees in
Bengaluru by officials of Bruhat Bengaluru Mahanagara Palike on the ruse
of widening roads. ESG has complained that in violation of law and in
variance to the judgment in our PIL (WP 7107/2008) against illegal road
widening by public authorities, forest officials had illegally permitted
the felling of hundreds of old avenue trees in important promenades of
Bengaluru. A committee of Experts appointed by the High Cout in the PIL
had not consensually agreed to widening roads without full compliance
with the law, and the matter had to be referred to the Lok Adalat per
the judgment of the High Court in the PIL. Instead of following this
direction, officials decided to fell over 300 trees on Sheshadri Road
during December, thus destroying one of the most charming boulevards of
Bangalore. In the process they disregarded complaints that these actions
were illegal and the widening would jeopardise pedestrians and cyclists
due to its poor design.

The Hon'ble Lok Adalat was very upset by such illegal actions and
decided to take away the powers of the Tree Officer for granting
permissions to fell trees. It was ruled that henceforth all tree felling
in Bangalore would be allowed only by the Adalat's permission. The
Adalat also decided to refer our PIL back to the High Court to rule on
the legality of road widening per the Karnataka Town and Country
Planning Act, and a variety of other urban administration legislations.

This victory has stalled efforts of rampant and illegal tree felling
under the watch of forest officials, and raised important questions
amongst many if a timber mafia is behind this programme. The Karnataka
Government must now defend before the Court how it can implement the
illegal road widening programme underway (about 100 major roads are
proposed to be widened in Bangalore) on the ostensible claim of
relieving the city of traffic congestion. This when not appreciating any
of the more progressive solutions such as enhancement of walking and
cycling opportunities in the city (a major relief in the age of climate
change), and advancing cheap and effective public transport (such as by
buses). The current road widening programme is bound to displace
hundreds of homes and businesses in core Bangalore, potentially fell
over 40,000 avenue trees (making it the single largest episode of
environmental destruction in the city's history) and jeopardise the
lives of thousands of pedestrians, cyclists, children, senior citizens,
differently abled and motorists, as the widened roads have absolutely no
safeguards build to protect lives and livelihoods.

World Wetland Day brings important PIL efforts to Court:*

On Monday, 2nd February 2009, World Wetlands Day, the Hon'ble High Court
of Karnataka will hear final arguments in two Public Interest Litigations.

One PIL initiated by Environment Support Group is against privatisation
of lakes in Karnataka by the Lake Development Authority. In response to
this PIL, the Government of Karnataka gave an undertaking that it would
withdraw its policy of privatising lakes. The private parties who are
beneficiaries of the policy, in particular East India Hotels (Oberoi
group), Lumbini and Biota have voluntarily accepted not to move ahead
with their plans to commercially develop these lakes. However, the
Government and private parties wish to continue with the long term
leases of the privatised lakes, which we have objected to as being
illegal. The final arguments will help shape a comprehensive policy on
ensuring lakes in Karnataka will forever remain in the commons and thus
enhance the possibility of water security for all. (Our PIL and the

In this regard we wish to draw your attention to a landmark ruling of
the Hon'ble High Court in a PIL filed against pollution and encroachment
of lakes (PIL WP 1841/2006) and connected during Hearings with our
ongoing challenge to privatising lakes. The Court has held that the
Karnataka Revenue Department (custodian of all lands in the State) will
survey each and every lake in the State to determine its legal
boundaries as a first step to removing encroachments and stopping
pollution. The supervisory powers of this effort has been given to the
Karnataka Legal Aid Services Committee. You can download this judgment

The other PIL is about the Bangalore Mysore Infrastructure Corridor
project, which is amongst the most controversial land deals and a
subject of litigation and political conflict for over a decade now. The
High Court will hear a batch of connected PILs and Contempt Petitions
relating to this controversial project - with major issues being the
excessive and illegal acquisition of lands unconnected to the project,
destruction of about 20 lakes by developer M/s Nandi Infrastructure
Corridor Enterprise around Bengaluru and serious violations of alignment
of the expressways built around the city. Former Prime Minister Mr.
Devegowda's book exposing the corruption and collusion in the project
along with his letter to Judges of the High Court on the issue have been
taken /suo moto/ as a PIL, and it should not be a surprise to see Mr.

Protest against Assault on Women in Mangalore Pub and State Inaction

We condemn the brutal and unprovoked assault by members of the Sri Ram Sena on young women in a pub in the coastal city of Mangalore, Karnataka, during the afternoon of Saturday, 24 January 2009. We are shocked by the inadequate and reprehensible response of the State administration, police, and political leadership, some of whom have dismissed this is as a 'minor incident'. We do not believe that violent threats to the democratic freedoms and human rights of all citizens, including women, can be treated as 'minor'.

To strongly condemn the disturbing trend of political and social violence against women as a means to enforce a particularly regressive interpretation of culture, there will be a protest on Tuesday 3rd February, outside Karnatak Bhavan, Chanakyapuri (near Samrat hotel) at 12at pm.

Please come with songs, slogans, placards and loud voices.

Please circulate as widely as possible.

Dear Friends,Comrades,Supporters,
Salaams.
We the vast multitude of unorganised workers do not want to be "beneficiaries" of any government's munificence. We are a 40 crore productive workforce and contribute through our labour 65 percent of the country’s GDP. We demand as a matter of right, minimum standards of social security for us and our dependents, along with well regulated employment, decent wages, fair and humane conditions of work and so on, in the formulation and implementation of which the workers will have a prominent role through tripartite bodies at various levels. All these and more must be ensured to us through a Comprehensive Legislation in which Parliament spells out minimum standards and guarantees instead of leaving it all to be prescribed by the government or by unrepresentative advisory bodies.
A lot of efforts went into the drafting of the Unorganised Sector Social Security Bill 2007 and after many struggles,the Houses of Parliament did pass this Bill, but a very diluted one.This Bill as it stands,is totally denying any social security to the workers.It makes a mockery of the contribution of workers,from the unorganised sector to the economy.There are very important additions to be made,to protect the workers.The Bill will be placed before the President,this coming parliamentary session.Hence there is no time and a huge signature campaign is being organised all over the country.With rallies,dharna,protests being organised all over the the country,the State Campaign Committee,is organising a dharna,mobilising signatures to be sent to the Central government.Please do come in large numbers and support the workers.

Challenging opportunity in Gulf of Mannar - Tamilnadu

Dear Friends
Anybody is ready for a challenging opportunity in Gulf of Mannar, Tamilnadu,
India. PAD needs an experienced person for the post of Project Director  to
manage the livelihoods and conservation programs.

People's Action for Development (PAD) is a not-for –profit development
organisation, working with the* vision* of values of equity (especially
gender equity), justice, freedom, peace and solidarity. The organization
aims at a balance between economic and social development and emphasizes the
need for conservation and sustainable use of endangered natural resources
and marine eco-systems. And with the mission of building peoples
organisation to address poverty through development innovations.

PAD's *mission* is to improve the socio-economic status of the marginalized
and poor and strengthen their participation in democratic self-governance
through the development of participatory mechanisms, self-help institutions
and policies. Special emphasis is put on ensuring child rights by
establishing a positive parenting environment and changing women's and men's
roles to decrease gender discrimination and promote gender balance.
PAD's holistic development approach is based on systematic and scientific
programme preparation, thorough participatory, democratic structures and the
implementation of sustainability and empowerment factors right from
programme initiation.

PAD is working in the tsunami affected coastal districts of Tamilnadu, India
with the long term goal of establishing sustainable livelihoods through
community based organisations. It works in 133 villages and reaching 32,500
poor families of gulf of mannar.

The workshop would give you an idea of what to look for while researching
institutions that would support your work and how to pitch to them in a way
that would be hard to refuse!

 *Who can attend?* All the communication staff of the voluntary
organisations

* Faculty: Nisha Purushothaman*   Nisha holds a Master's Degree in
Communications and over the last 7 years has been developing training
curriculum and course content. She trains voluntary organisations in
developing strategies for a diverse income base. Nisha works with
organisations to build skills for preparing communications material such as annual reports, brochures,
newsletters and direct mail packages.

*Nino Charles*   Nino has a Master trainer certification from the Cambridge University, UK and a background
in strategy and human Resources. With a Master's in Social Work and over ten years of training experience,
Nino works with organisations to develop fundraising strategies and evolve effective fundraising techniques.

IFP background*

IFP builds skills and nurtures social communicators and fundraisers to
effectively communicate and engage society in causes; while helping
voluntary organisations raise resources and be accountable. IFP is an
initiative of Murray Culshaw Consulting – the pioneers of fundraising and communication training in India.

The Institute builds on 13 years of training experience, arising out of skill-building workshops,
custom-built courses and hands-on experience of adapting learning for over 1,000 small, medium and
large voluntary organisations in India and South Asia.

Consultation fee: Rs 5,000 per person, *includes registration, course
