UN disability rights body confirms that equal access to banking services should be granted to all


One of the newest United Nations human rights treaty body, the UN Committee on the Rights of Persons with Disabilities, issued an unprecedented decision on a case involving Szilvia Nyusti and Péter Takács, two visually impaired complainants from Hungary.

Seven of the human rights treaty bodies (the Human Rights Committee, the Committee on the Elimination of Racial Discrimination, the Committee against Torture, the Committee on the Elimination of Discrimination against Women, the Committee on the Rights of Persons with Disabilities, the Committee on Enforced Disappearances, and the Committee on Economic, Social and Cultural Rights) may, under particular circumstances, consider complaints or communications from individuals who consider that their rights have been violated.

The ruling of the disability rights body was made in favour of the two plaintiffs who, under article 2 of the Optional Protocol to the UN Convention on the Rights of Persons with Disabilities, put forth the “failure by [Hungary’s] authorities to eliminate discrimination on the ground of disability by a private credit institution and to ensure that persons with visual impairments have an unimpeded access to the services provided by the ATMs on the equal basis with the other clients”.

Both claimants were clients of the OTP Bank Zrt. and paid annual fees, equal to those paid by sighted clients, for banking card services and transactions. However, Nyusti and Takács were unable to use the OTP ATM machines without assistance, as the keyboards were not marked with Braille fonts, nor did they provide voice assistance.

In April 2005, the plaintiffs’ lawyer lodged an unsuccessful complaint to the OTP Bank, requesting for ATMs in the proximity of his clients’ homes to be retrofitted for their unrestricted use. Five months later, Nyusti and Takács brought a civil action to the Metropolitan Court where they asked the court to recognize that OTP was violating their right to equal treatment under the Hungarian Civil Code - in particular the Equal Treatment Act, and to request a Court order to retrofit part, if not all, of the ATMs operated by OTP across the country.

Six months later, OTP requested that the civil action be dismissed, stating that the extra services demanded by the plaintiffs would constitute positive discrimination, which could only be prescribed by law. The bank also claimed that it was primarily a governmental obligation to ensure unimpeded access to buildings for persons with disabilities and that the ATMs operated by the OTP were not “buildings”. The bank further claimed that since both contracts were concluded by the plaintiffs prior to the entry into force of the Equal Treatment Act, the latter was inapplicable to their case.

In May 2007, the Metropolitan Court ordered the OTP to retrofit within 120 days at least one of its ATMs in the capital towns of each county, one in each district of Budapest, and four further ATMs in the districts where the authors resided.

However, the plaintiffs went against this decision at the Metropolitan Court of Appeal, asserting that their activities should not be limited to the cities where the ATMs were to be made accessible following the decision of the Metropolitan Court, as they were entitled to freedom of movement and the right to choose their place of residence. They requested that all OTP ATMs be made accessible, to end the discrimination fully and not partially, arguing that the operation would not constitute a significant financial burden to the bank. The appeal was rejected.

In April 2008, the plaintiffs submitted another request, this time to the Supreme Court, hoping to have the decision by the Metropolitan Court of Appeal overturned.  The OTP Bank, on the other hand, pleaded for the decision to be upheld, claiming that the contracts signed by both plaintiffs confirmed their acceptance of the conditions in which the bank’s services were provided.

Practically a year later, the Supreme Court rejected both requests, sharing the opinion of the Metropolitan Court of Appeal.

After a five-year legal battle, judging that they had exhausted all domestic remedies, Nyusti and Takács filed an individual complaintagainst Hungary through the UN committee in charge of protecting the rights of persons with disabilities.

The complaint sought to substantiate the failure by Hungary, through its institutions, to provide “equal and effective legal protection against discrimination on the ground of disability; reasonable accommodation; accessibility of information; right to control one’s own financial affairs.”  It claimed that Nyusti and Takács had been victims of a violation of their rights under articles five, 9 and 12 of the UN Convention on the Rights of Persons with Disabilities, to which Hungary is a party.

After having considered the admissibility and the merits of the claim, the Committee concluded that Hungary had failed its treaty obligations under article 9, paragraph 2(b) of the Convention.

The Committee established that “the State party is under an obligation to remedy the lack of accessibility for the [plaintiffs] to the banking card services provided by the ATMs operated by the OTP.” It also recommended that Hungary take preventive measures against future violations by establishing minimum standards for the accessibility of banking services provided by private financial institutions for persons with visual and other types of impairments; to ensure that all newly procured ATMs and other banking services are fully accessible for persons with disabilities; and provide for appropriate training on the Convention and its Optional Protocol to judges and other judicial officials in order for them to adjudicate cases in a disability-sensitive manner.

This year marks the 20th anniversary of the World Conference on Human Rights, which led to the adoption of the Vienna Declaration and Programme of Action, and the establishment of the UN High Commissioner for Human Rights to oversee the international human rights framework, promote human rights and protect individuals against abuse. 

There are ten core international human rights treaties, some of them being supplemented by optional protocols dealing with specific concerns. The Convention on the Rights of Persons with Disabilities was adopted by the United Nations General Assembly on 13 December 2006, and opened for signature on 30 March 2007. Following ratification by the 20th party, it came into force on 3 May 2008. In the past two decades, individuals have been given far more access to international and regional institutions, and are entitled to report violations and demand justice.

TRANSPARENCY AND PEOPLE FRIENDLY COURT SYSTEM  

Please recapitulate that this court has said in  M/s. Kranti Associates Pvt. Ltd. Versus Sh. Masood Ahmed Khan -JUDGMENT 8.9.10, “It cannot be doubted that transparency is the sine qua non of restraint on abuse of judicial powers. Transparency in decision making not only makes the judges and decision makers less prone to errors but also makes them subject to broader scrutiny. (See David Shapiro in Defence of Judicial Candor (1987) 100 Harward Law Review 731-737)” The RTI Act has been enacted in order to promote transparency and accountability in the working of every public authority.

 

The Public Authorities have been empowered to frame rules in tune with the Act to regulate the provision of information but this Hon’ble Court has not framed any rules in this behalf. The information exempted from disclosure is enumerated u/s 8 of the Act. Legislature is supreme in it’s sphere and the intention of the Legislature is very clear that all the information except those exempted explicitly under law must be disclosed to citizens. Unfortunately this court has been denying access to judicial records, which is the main function, to citizens under RTI Act. The Madras High Court, vide Regulation No.4, allows access to Judicial Records under RTI Act. The said Regulation of  MADRAS HIGH COURT RIGHT TO INFORMATION (REGULATION OF FEE AND COST) RULES, 2007 goes on to say, “4. Charges.- For providing the information under Sections 7(1) and (5) of the Act, the following charges are payable :-

(3) the application requiring copy of order, judgement/ statements/ reports shall accompany, in addition to the application fee, a sum of Rupees 100 towards cost. If, the actual cost of charges for information exceeds Rs. 100 then the same would be intimated to the applicant and the copy of information would be furnished on payment of excess amount; …” The judicial records are available in electronic format in USA , and access to judicial records is open and free without any charges. Even access to foreigners is allowed as per enclosure & the emails are attended to and responded promptly without any lethargy.

 

This court is also aware of the ravaging corruption stretched in Ministerial Staff of Indian Courts .The Joint Conference of Registrar Generals of High Courts and Law Secretaries of the States held on 23rd December, 2006 recommended that- ‘there should always be a Vigilance Cell in each District, to be headed by a senior Judicial Officer. The Vigilance Cell shall keep effective control on the staff of the Courts and regularly monitor their activities so that the image of the Courts is not tarnished in the eyes of general public. The dates in the cases should invariably be given only by the Presiding Officer and the PRACTICES AND PROCEDURES SHOULD BE STREAMLINED SO AS TO MINIMIZE THE CONTACT OF THE LITIGANTS WITH THE MEMBERS OF THE STAFF.’

 

The records of Courts are available freely in Indian Courts on payment of tips to Ministerial staff is a well known fact from north to south or east to west. However the rates may vary according to status of court. Thus the access to Court records in a superfluous manner can’t be prevented by the administration as helpless shown in the conference above. Therefore it is in the larger interest of democracy that the access to court records, subject to just exemptions, be allowed under RTI Act to bring transparency in working, and curbing malpractices in Registry of the courts.

The government is considering taking steps to set up separate regulators for power and water sectors after unshackling their distribution from public sector monopoly.

Finance Minister P Chidambaram has stressed the need for the same for these sectors, days after asserting that independent regulators for road and coal sectors will come up by August-September this year.

“We need separate regulators for such sectors (power, water),  whose role will be to keep the private producer working for the public interest while ensuring the producer makes reasonable profits and that the public sector does not transfer undue risk on to the private sector,” Chidambaram said.

The move may be part of small steps the finance minister recently promised the UPA will take, in order to carry forward economic reforms in the absence of Opposition support in the Parliament to push through big ticket reform measures. Also, such measures can tackle problems faced by the public utilities, including their tardy distribution.

The new National Water Policy too suggests that the government withdraw from its role as a service provider in the water sector. Instead, it says, communities and the private sector should be encouraged to play that role.

Power and water are two main public utility services remain under state monopoly in India. But, the finance minister is of the view that with advancement in technology, multiple producers can be involved in distribution of power from the same grid. But when it comes to water distribution, not much headway has been made for privatisation, Chidambaram recently said, acknowledging though much of India has moved towards privatisation of different sectors.

“Fortunately, there are fewer and fewer situations where pure natural monopolies exist. For instance, power distribution… nevertheless, there are still a number of areas, many of them involving services to the public such as water distribution, which are natural monopolies,” Chidambaram said.

A working group of Planning Commission recently recommended privatisation of water distribution saying it would ensure efficient water supply and help plug water and revenue leaks. A similar move by the Delhi government to privatise water distribution was opposed by experts but Karnataka recently became the first state in the country to privatise water distribution with several towns being managed by private companies under a 24X7 water supply scheme.

Promising separate regulators for road and coal sectors, Chidambaram had last month said, “There are often problems during implementation of road and coal projects. The government hopes to make the process easier with separate regulatory authorities that will be able to place effective mechanisms”.

The 11th International Conference on AIDS in Asia Pacific (ICAAP) will be held on 18 to 22 November 2013 at Bangkok. This ICAAP will have special focus on Youth and Leadership as well as wider participation of community of HIV affected, MSM, and related issues.

Youth Working Team (YWT) is a coalition of networks and organizations representing youth in Asia and the Pacific region. YWT is a consortium of organizations that serve and participate in various international events.

{i} Inviting applications for a performance research project:



The Arshinagar Project invites actors, dancers, musicians and others to apply for the first phase of a research process focussing on the performer's craft.

Using the poems of Faiz Ahmad Faiz as a take-off point, we will undertake an intensive investigation of physical and vocal process, through the aspects of breath, rhythm, physicality and musicality. Participants will be exposed to the psycho-physical approach of The Arshinagar Project towards performance making, and will also have a chance to work with master-performers from both traditional as well as contemporary disciplines. 

The first phase of this research is divided into three workshops. The first will be in Kolkata between June 17th and 23rd, the second in Delhi between July 8th and 14th, and the third in Kolkata again between July 28th and August 10th. This phase of work will culminate with a work-in-progress sharing on the 11th of August in Kolkata. At the conclusion of the first workshop on June 23rd, the research ensemble for the second and third parts will be chosen. 

Participants will need to cover the costs of their own travel and accommodation.

Participants will need to be fit enough to undertake strenuous physical work and preferably have musical ability. The Arshinagar Project is envisioned as a collective of artists
and cultural practitioners from different traditional and contemporary 
disciplines, as well as practitioners from other disciplines such as 
anthropology, education and ecology, for research into performance 
as transformational action.
'Arshinagar' means 'the city of mirrors', and the name is derived 
from a song by Lalon Phokir, one of the greatest masters among 
the Bauls of Bengal - wandering mystical musician-performers who 
through embodied practice attempt to touch the unbodied.The logo 
represents the 'ektara' (literally 'one-stringed') - a drone-like 
instrument used in different forms and names in different Asian 
cultures, which has come to symbolize the Bauls.
The Arshinagar Project aims to foster a spirit of freedom, respect for 
human diversity, ecological harmony and love, among young adults, 
youth in colleges and universities, educators and others, through 
performances, immersive workshops in urban and natural settings 
based on traditions of mystical performance and practice as well as 
contemporary performance-craft, through lecture-demonstrations, 
seminars, and journeys through inner and outer spaces.

The Human and Institutional Development Forum is interested in knowing more about the needs of NGO's across India.  We have funds to help - both through training and through organisational accompaniment processes - and are interested in knowing what real concerns and current interests are across civil society.
