We The People have the right to know : Who is "Transparency Officer" at DoPT Goi New Delhi...

Dear Dr Manmohan Singh,

We, The People have the right to know as to who is the "Transparency Officer" at DoPT, the Nodal Govt Agency implementing Transparency Law to improve transparency and accountability of public administration towards the citizens.

Kindly direct DoPT to make it public without further waste of time.

The concerned citizen complaint Shri Sarbajit Roy, who has been trying hard to contribute towards improving the governance, also be informed directly.

Sub: PUBLIC GRIEVANCE PETITION: Who is "Transparency Officer" at DoPT

As I have oft complained in previous (and pending) Grievance Petitions, the DoPT has comprehensively failed to comply with the mandate of section 4 of the RTI Act 2005 which is administered by your Department. I have suffered great loss, harm and/or detriment thereby.

Taking cognisance of the State's woeful track record in document management and proactive disclosure in my case, the Central
Information Commission (by order of Shri A.N.Tiwari) had directed all Secretaries to the Govt of India to appoint senior level officers (of the level of #2 or #3 in the hierarchy of the department) as "Transparency Officers" within November 2010. This directive dt 15/Nov/2010 of the then Chief Information Commissioner was later ratified by all Central Information Commissioners and duly communicated by a DO dated 18.Nov.2010 to yourself..

It is noteworthy that virtually all Departments/Ministries have complied with the said direction and appointed Transparency Officers well in time, this includes bodies like the Cabinet Secretariat and the PMO etc. The DoPT, however, under your able stewardship is a resolute holdout and has quite properly decided to ignore the said directive as being bad in law. As usual I am in complete agreement with the stand of the DoPT that the CIC is off his rocker and has no powers to issue such directions off his own bat (unless some complainant or appellant first bowls a ball for him to hit you with). I also agree with DoPT that the CIC cannot condone the brazen disregard and contempt for section 4 of RTI Act (which incidentally DoPT delights in instructing other public authorities to flout via DoPT's circulars) and grant public authorities more time to comply than the RTI Act permits.

I therefore pray that I be formally informed by DoPT immediately that there is no Transparency Officer at DoPT (along with brief reasons) so that I can lodge my grievance to Madame President's online grievance facility asking for this wasteful, non-statutory and unlawful scheme of CIC to be scrapped. If, however, the DoPT has appointed / designated a Transparency Officer, his/her particulars may kindly be provided to me. This information is also sought by me u/s 4 of the RTI Act.

A tinkerer's budget

The budget was a non-event.
It is a tinkerer's budget; I impose a few crores here, I give reduce a few crores there.
It is completely lacking in vision, and fails to even acknowledge the burning issues of food price inflation (agricultural chain productivity), corruption, mal-governance.
One would have liked the thousands of babus that eat up hundreds of crores in salaries and benifits to have produced a document better than an accounting document, eg. a thrust in agricultural chain productivity vis-a-vis world standards:  a dramatic funding of watersheds, soil and water conservation, linkage of babu salaries to increased productivity by, say 50% in 5 years, formation of agricultural co-ops; dramatic increase in canning of foodstuffs (and zero taxes thereon); improved seeds, farmer training, etc, etc.
One would also have liked to hear about doubling or trebling of resources to justice delivery system, so that errant are punished swiftly, and crime carries some real costs that are several fold higher than acquisition price.
It is many months, if not years, since the issue of huge corruption monies came up.  Other than a few being put behind bars for a few days, there is nothing elese by the government to show for.  This applies equally to BJP, except for Mr. Nitish Kumar (long live Mr. Nitish Kumar.)  All this goes to show that we should not expect anything much from the government.

God help India, for it is headed for very troubled times in the coming decade or so.

MARCH-2011: IMPORTANT GROUP POLICIES

Dear HJ Members

Report of the Group's moderators:

1) In the month of February about 304 messages were posted/circulated to the group. About 78 messages were blocked, filtered to maintain this group's limit of 300 posts per month (most of these were of the "thank you" / "I agree with you" variety which contribute nothing to the.discussion, a few were abusive towards the moderators).

2) The moderators opine that this group is now mature and well adjusted. The group's policy is also sufficiently well known and trusted to be enforced  by now.

3) Accordingly, we have decided that each month we shall permit 2 OPINION threads which have nothing to do with RTI but which may interest our members. These are free for all threads and posts to them don't count towards 300 mail limit. This month Mr S.D.Sharma has proposed 2 topics (from next month members may suggest their own). The first one is based on a phrase I copyrighted.

A) "MARCH-2011, The RTI Act 2005 is the biggest fraud on the citizens of India since the Nehru-Gandhi family"

B) "MARCH-2011, Corruption in the judiciary has crossed all limits"

[rti_india] GOVT TO TAX THE SICK...HOW SICK IS THAT !

 

Every sick person is soon going to be a Federal revenue generation opportunity. Finance Minister Pranab Mukherjee has proposed a service tax on us every time we fall sick, get hospitalised, get operated upon in an airconditioned hospital with more than 25 beds, get exploratory medical diagnostic tests, etc. etc. There are only two ways of not paying this tax. Raise our voice against it and ensure the great minds in the ministry who thought up this SICK TAX withdraw it pronto or hunt for a hospital with less than 25 beds and an operating theatre without air conditioning!

    furthermore corporates can claim back the service tax paid for
    hospitalisation of their people..

      I don't see why Mr Sarbajit has to inform "his" members about an NCPRI meeting in Shillong.

      If somebody has posted a message to any of the several RTI egroups which Mr Sarbajit is a moderator of, and some other moderator excises such emails iti s not my problem.

      Furthermore, I dont know why the stalwarts of the NCPRI (each of whom has posting privileges to groups of the RTI-Unity project want to post thorough pseudonymous dummies / proxies, instead of using a word-processor and chipping the delicate nail-polish on their delicate little (foreign financed) fingers.

      Self help is best help. Apna haath jaganath etc etc..

      Even if informed, there are rare chanches for any group to go to Shillong.  However, for a member residing there or at nearby area may be able to attend, that too if invited.
       
      Let up see whether NCPRI sends report of mega convention to the moderators of the group.  If so, whether moderators upload that for the infn of members or not. 
       
      Relationship of Shri Sarbajit Roy with NCPRI and other activists are well known to all of us.  It is useless to blame Mr Roy on his failure to inform the member about the mega convention. 
       
      As claimed by Mr. Sarbajit Roy, if the each stalwarts of the NCPRI has posting privileges to groups of the RTI-Unity project, why a proxy was used.  Only by working in unision, v can achieve something.  Remember, unity is strength.  No one is more powerful than all of us.  If we are not united, any body can imploy the policy of divide and rule.
       
      I appeal to all the formation to come closure by forgetting small differences.  All are important ingridents and contributing to their capacities.  When the country is deep in the scams - one after the other - it is the duty of all of us - specially of RTI activists, lawyers, journalists, to take a lead and show the corrupts their right place.

      For once (or once again) I agree with you.

      1) It is imperative that HONEST citizens collaborate / unify to combat the all pervasive stench of corruption that pollutes India's society and polity today.

      2) This group (and other groups of RTI-Unity project) are genuinely unmoderated and uncensored groups. At worst we "kick off" members who exceed our predefined and publicised limits (although I try not to, and Sharmaji sometimes get carried away). I'm
      sure you can confirm all this from your own experience. In any case our group messages are an open book.

      3) Unfortunately, NCPRI people (there are 1 or 2 exceptions) have some allergy to posting on groups which are not controlled by them. The NCPRI functions as a "cult" where everything is secretive and nobody can speak our openly / disagree with the leaders. I learned this from PMK who admitted to me much later that he had stopped my posting to HJ-YG at the prompting of a senior NCPRI person who had issued a "fatwa" (copy of which is with me).

      4) I have every cooperation / sympathy / assistance for genuine RTI activists, but not
      for foreign financed blackmailers / parasites who masquerade as RTI activists.

      5) I reiterate that we are not here to give a free platform to publicise NCPRI or other NGOs. It takes 2 hands to clap, but only 1 to slap. Reciprocity is the need of the day.
