Prime Minister - IOC Jaipur Fire - "Our husbands were murdered" - Loss of Govt sector job on raising corruption issues & murder of key witnesses has been happening in India. [1 Attachment]

Dear Dr Manmohan Singh,

Mysterious death of key witnesses has been happening in India including the one that took place in PF Scam involving SC / HC Judges and the possibility of the IOC two Officers burnt to death because of their knowledge on heavy stock losses at IOC Jaipur Terminal, and adjacent HPCL Terminal, that was reportedly under investigation by CBI for a very long time prior to IOC Jaipur inferno that commenced on 29th October 2009. 

Further, losing Govt sector job on raising corruption issues has not been new and the recent glaring examples are that of Mr Ashok Singh & Mr RP Srivastava of HPCL who lost job primarily because of their exposing corruption by Mr Murli Deora in Kerosene Marker case. 

That is what the IOC counsel need to keep in mind before raising finger at brother Advocate Mr Mahendra Gaur who, incidentally happened to be my Controlling Officer as Deputy Manager (Technical Services) while I was Asstt Manager (Technical Services) at IOC Ahmedabad during 1988-89. Advocate seems to be making sinister effort at diverting the crucial issue.

It may kindly be appreciated that the charges levelled by the widows are very very serious in nature that cannot be brushed aside lightly and, in the interest of justice, must be properly investigated expeditiously to nail down criminal culprits as the enormous power of the State should not lead to torture or physical harm to the widows already suffering due to criminal negligence of Board of Directors who are still allowed to roam free and reportedly tampering with the evidences.

    Dear Madam,

    In the economic liberalisation era that commenced in India in 1991, the credit for which is being given to economist Dr Manmohan Singh. what has been achieved during the last two decades is the extremities of rich & poor, as can be seen in the enclosed Planning Commission data, and the spread of Naxals to larger part of India & bloodshed.

    While India's National Policy on Housing considers "Shelter is a basic human need next only to food and clothing" (http://xrl.us/bh6edr), Affordable Housing, under Dr Manmohan Singh as the Prime Minister, has remained only on paper unlike in Brazil (one of the 4 BRIC Countries having high growth) where social development got equal importance under President Mr Luiz Inácio Lula da Silva (not sold out to Capitalists) and his party has been able to elect Ms Dilma Rousseff as the next President. 

    Considering the total ineffectiveness of Dr Manmohan Singh as the Prime Minister, on every front listed below, it is high time that he is replaced by a competent & effective administrator who can ensure rule of law, transparency in working and making administration accountable to the public. Sooner the better for the mankind.

    Dear Sir,

    I am the king of the house and I have the permission of my wife to say so. That is what I read on the wall of one house few decades back. While working at someone’s mercy and operating on borrowed authority that is the situation in which I can visualise you to be.


    Further, during your tenure as the Prime Minister of India, you have:

    ·         Leave apart improving transparency in administration, you have never uttered a single world to improve transparency in administration. And, you have miserably failed on this count.

    ·         Leave apart improving accountability of administration towards the citizens, you have not shown the courage to utter a single world that you would make the administration accountable to the citizens. And, your performance in this regard is painfully dismal.

    ·         Leave apart reducing corruption in public administration, during your entire career you never mentioned zero tolerance for corruption to help masses to get what has been legitimately due to them. And, you have been at the centre stage of administrative decisions increasing high level corruption in India. Huge amount of money that lawfully belongs to the citizens of India but swallowed by corrupt elements in politics, in business, in bureaucracy for more than six decades has still not brought back lying in the banks of other countries. What all I have been informed is that the Govt is seized of the matter.

    ·         Official Secrets Act 1923 enacted by the British Rulers, for the reasons best known to you, is still not repealed.

    ·         You have simply not done anything to save the nascent Right to Information Act 2005 but allowed it to be butchered by the bureaucrats & public servants by abusing the authority and more so CIC / State CICs. You have even weakened RTI by taking out Directorate of Income Tax (Investigation) of the purview of RTI so that high level financial malpractices and political corruptions do not come out in the open, You have knowingly allowed DoPT to have extra-constitutional authority in the matter of “File Notings”.

    ·         You have preferred not to implement the fundamental right to education of the children of this country & thereby keeping them as illiterates. I really feel ashamed at your performance on this.

    ·         You have not changed the National Water Policy 2002 (that permits private ownership of water reservoirs) despite my repeated requests, you are allowing commercialisation of water and you have not ensured that the citizens of this country get clean water to quench their thirst and remain alive.

    ·         What all you have done is provide housing to the nearly three percent of the citizens and you have not fulfilled even ten percent of the target of providing shelter as covered in National Housing Policy. Urban Land Ceiling Act is repealed / SFIs are increased / mammoth size loans are given out of our money to the builder lobby to mint money. But no houses are in sight for the citizens who have no shelter. Even the recent Congress Manifesto is silent on housing that the basic necessity of life next only to food.

    ·         By commercialisation of medical facility while not improving the condition of the Govt run hospitals, you have ensured that millions of young children remain rickety if they survive their first birthday.

    ·         In urban area, people, by & large, get 24X7 power supply while in rural area, they remain at the mercy of Almighty to get supply.

    ·         In railway trains, unreserved ticket passengers travel in inhuman condition in overcrowded coaches. Same is the case of the jails where jail inmates since occupancy rates in umpteen no. of jails is more than two hundred percent.

    ·         GINI Coefficient showing the ratio of rich vs poor citizens in the country is tending northward for India. By your economic policies, what all you have done is making rich the richer and poor the poorer thereby making them vulnerable to all sorts of exploitation.

    ·         GINI Coefficient also show that urban population has richer not the rural population.

    ·         So far as the justice delivery system is concerned, less said the better. You have just not done anything to ensure that a common man gets timely justice.

    ·         As Chairman of Planning Commission of India, you have not published even on National Human Development Report during your entire tenure. And, you need to apologise the nation for this total failure.

    ·         RTI information requested by me from your office says that the Government does not know as to how many persons died of hunger in India.

    ·         Safety is provided at our cost to the big-wigs in the Y-category and Z-category & Z-plus category but measures are not taken to improve our safety. 


    In nutshell, that is what I view your performance.


    That being the case and when you already have two heart surgeries and you are not so young at 76plus, can you tell me one good reason for following the instruction of your political boss to become the Prime Minister of India again?


    Can you tell the nation that you are not capable of handling the responsibility and thereby save us?


    It will be a great service to the human kind.

      On completion of 5 years of Information Act , the passivity and indifference of the government machinery that and Information Commission throughout the country in 2009-10 to 10 activists working in different cities were killed. This resulted in a kind of disappointment , the reason is also that thousands of people across the country has formed small small groups and started digging out information of all the big cases of corruptions . the irony is that they never thought of this situation and be united nationwide or state wise,
      Through all these distressed , some workers of Uttar Pradesh taken an initiative and invited people across the state on 30 and 31 October at Aligarh for consultation and discuss the situation as created by the Public Information Officers of various Govt. Department , and the illegal decision of the Commission acting as an agent to various government departments. After thorough day long discussions and deliberations evolved a furmula and decided to furm a federation of all the RTI activists of the Same in the name of RTI COUNCIL OF U.P. To improve the coordination of all possible organizations to work it to run smoothly , formed a 15-member Governing Body with the coordinator as Shri Anil Jani , Meerut and Mr. Akhilesh Saxena, Lucknow
      The Governing body will meet again within 45 days to take stocks of the progress made.

      IT IS EARNESTLY REQUESTED THAT ALL THE INDIVIDUAL ORGANISATIONS, NGO, INDIVIDUALS SHOULD JOIN THIS COUNCIL INORDER TO STRENGHTEN THE CAUSE OF RTI MOVEMENT IN UTTAR PRADESH>

          On completion of 5 years of Information Act , the passivity and indifference of the government machinery that and Information Commission throughout the country in 2009-10 to 10 activists working in different cities were killed. This resulted in a kind of disappointment , the reason is also that thousands of people across the country has formed small small groups and started digging out information of all the big cases of corruptions . the irony is that they never thought of this situation and be united nationwide or state wise,
          Through all these distressed , som e workers of Uttar Pradesh taken an initiative and invited people across the state on 30 and 31 October at Aligarh for consultation and discuss the situation as created by the Public Information Officers of various Govt. Department , and the illegal decision of the Commission acting as an agent to various government departments. After thorough day long discussions and deliberations evolved a furmula and decided to furm a federation of all the RTI activists of the Same in the name of RTI COUNCIL OF U.P. To improve the coordination of all possible organizations to work it to run smoothly , formed a 15-member Governing Body with the coordinator as Shri Anil Jani , Meerut and Mr. Akhilesh Saxena, Lucknow
          The Governing body will meet again within 45 days to take stocks of the progress made.

            "BJP seeks JPC probe" is no way of governing the country. Prime Minister cannot be allowed to have unbridled discretion on whether to go for JPC Probe or not...

             

            Dear Dr Manmohan Singh,


            "BJP seeks JPC probe" is the hot issue now in the matter of corruption in CWG as also in Adarsh Society Scam (http://xrl.us/bh6f6j).

            It was the hot issue in the matter of Phone Tapping (http://xrl.us/bh6f6h) some time back.

            It was also the hot issue in the matter of IPL (http://xrl.us/bh6f6w).

            While in the CWG Scam, so far, you have not indicated anything on accepting the demand of main Opposition BJP for JPC probe but, considering the dire need and justified hue & cry by the entire nation, the issue would be taken up strongly leading to avoidable disruption in the proceeding in the Parliament causing loss of working hours of the Parliament and wastage of public money achieving little tangible.

            Earlier, in recent past, on Phone Tapping & IPL issues, you flatly refused JPC probe in an unreasoned and unjustified manner. That is nothing but outrageous decision reflecting autocratic, high-handed and arrogant working abusing majority by the ruling coalition with you as PM. 

            Dear Dr Singh, this is no way of running the country, Prime Minister cannot be allowed such unbridled discretionary power and there has to be a system in place to tackle such issues in a better manner.

            Please involve all the major political parties, other stake-holder, seek views from the citizens by giving them reasonable / reasonable opportunity and then firm up the possible items / expected eventualities under which the Govt is obliged to order JPC probe even without asking for it by the Opposition.

            Please be pragmatic, learn from the past and take some  sensible policy decisions on such larger public issues affecting the entire country and affecting our lives.

            BJP seeks JPC probe

            The Bharatiya Janata Party on Tuesday sought a joint parliamentary panel probe into massive corruption in preparation and conduct of the Commonwealth Games and called for fixing accountability on those who cleared the projects and sanctioned fund allocations overlooking the serious discrepancies and exorbitant cost escalations.

            Describing corruption in conduct of the Games as “loot” of public fund, BJP president Nitin Gadkari said people of India have a solemn constitutional right to know who the real culprits of this national shame are.

            Demanding setting up of a Joint Parliamentary Committee at the earliest to probe into this monumental scam, Gadkari said the terms of reference of the proposed JPC, among other things, should include devising a foolproof mechanism to ensure complete transparency in hosting a corruption-free and scandal-free international sporting event in future.

            “The truth must prevail and shall prevail only if a comprehensive inquiry in the public domain is held and that is possible only through a joint parliamentary probe,” he said.

            “I hope and I am confident that the Prime Minister will consider our demand for a JPC probe. We will also raise this issue in both the Houses of Parliament in the forthcoming session,” he said.

            Addressing a Press conference here, Gadkari targeted Prime Minister Manmohan Singh and his entire Cabinet, alleging that the Prime Minister himself sanctioned advances to Organising Committee head Suresh Kalmadi.

            “Are you not directly responsible for all this mess? Is the whole Cabinet not responsible for CWG chaos and corruption?” Gadkari said, raising questions for the Prime Minister.

            Alleging that that the Union Cabinet did not try to verify the reasons behind the escalating costs, Gadkari said, “All types of increase in estimates were approved by the Cabinet sub-committee and the PMO. Before approving (the inflated costs), why they did not verify,” Gadkari asked.

            “His (Kalmadi’s) credentials are known to the country. What Suresh Kalmadi is and what he has done is known to everybody in the Congress party. Has the Prime Minister released these advances on his advice? And before releasing these advances why did he not follow the rules?” Gadkari demanded to know.

            He also sought to bring Congress general secretary Rahul Gandhi and Union Minister Jyotiraditya Scindia in the line of fire, saying as members of the Organising Committee they were also accountable.

            Claiming to have documentary evidence, Gadkari said, “The first advances released to Suresh Kalmadi were by the Prime Minister. He has signed it. Why? and why was there no control over it?”

            Referring to the inquires by former CAG VK Shunglu and Government agencies like the Enforcement Directorate, the CVC, the CAG, the CBI, the Revenue Intelligence and other outfits, Gadkari said the BJP strongly believed that all these inquiries and investigations must be expedited to reach some logical conclusions at the earliest, so that the guilty could be punished without any further delay.

            “In view of the multiplicity of the agencies involved in this task, we demand that a high-power coordination committee headed by the Cabinet Secretary should be set up to ensure an effective and concerted effort to unearth the scandals,’ he said. 

            “All these investigations must reveal the extent and magnitude of corruption in different deals and the role of the agencies involved therein for which those found guilty must be taken to task as per the law of the land,” he said. 

            Asserting that it was high time to expose nexus between the partners in the Commonwealth Games loot and those providing them political patronage by condoning this mess, Gadkari said, “I strongly feel that there is an urgent need to pinpoint accountability on those who cleared these projects and sanctioned funds from time to time overlooking the serious discrepancies in the project reports and the unreasonable exorbitant cost escalations.” 

            The BJP president dubbed the ongoing probes as “an eyewash and said these are focused only at the administrative level. “ I don’t think those investigating can probe the Ministry-level involvement. What is going on is an eyewash.” 

            “They only indulged in corruption. They only spoke against it. And now they are putting on an act of taking action against it. And then of hiding the facts. I think this is all drama,” he added.

            Asked if the BJP would take action against any of his party members found guilty in the scam, Gadkari said, “Action should be taken against whoever is involved.... I have already said anybody - inside or outside the party - if found guilty, strict action should be taken against them.”

            Gadkari also distanced himself from party member Sudhanshu Mittal and Harish Sharma, at whose offices the Income Tax department had conducted raids in connection with the CWG contracts.

            “What Sudhanshu? Who Sudhanshu Mittal? I don’t know him. We are not concerned with them. Government should take action,” Gadkari said.

            The senior BJP leader said none of the party members who were part of the CWG Organising Committee were involved in the scam.

            “Vijay Goel was a member but when he raised his voice, he was thrown out...VK Malhotra gave several dissenting notes and wrote letters.... He did not take even one rupee... The Organising Committee was like a one-man army,” Gadkari said.

            He maintained that if the Municipal Corporation of Delhi, where the BJP has a majority, is guilty of corruption, action should be taken against its members.

            Gadkari raised questions about the huge increase in the budget allocated for the Games, which was billed at Rs 2,000 crore in 2003, but went up to Rs 70,000 crore in 2010.

            “There was great, great, great corruption in building of stadiums,” he alleged.

                The trend of government officials approaching the High Court against the Central Information Commission's (CIC) decision imposing fines on PIOs for delay in information to applicants under the RTI Act has started a debate amongst the RTI activists. Activists said very few information commissioners have levied monetary fine on the Public Information Officers (PIOs), who do not comply with the provisions of the Right to Information (RTI) Act.

                And now the decisions of those who impose fine are being challenged in the court.

                Two recent instances saw the Delhi High Court reduce the penalty imposed on the PIOs for not providing information on time.

                In case of Municipal Corporation of Delhi (MCD) vs Atma Prakash Mehta case, justice S Muralidharan had reduced the penalty.

                He ordered for the penalty on the MCD official to be reduced from Rs 18,500 to Rs 7,000, to be recovered from him in two equal installments of Rs 3,500 per month in view of the "facts and circumstances" of the case.

                Gaurang Kant, the lawyer who represented Mehta, said, "The CIC had imposed the fine in excess by way of two orders against the same appeal."

                In the RA Haritash vs Anand Bhushan case, the Delhi High Court took it on record that the information was ultimately

                provided on March 27, 2010, when the application under RTI was originally filed on November 4, 2009.

                The PIO claimed he had joined on November 18, 2009, 14 days after the RTI application was filed.

                The HC ordered reduction of the penalty from Rs 25,000 (to be recovered from the official's salary) to just Rs 2,500 (to be recovered from his salary in 10 installments).

                Vibhav Kumar, an activist-member of NGO Kabir, said, "Overall it seems that the judiciary is working to weaken the RTI Act. Orders like this wherein penalty amount is reduced will encourage more PIOs to not give information on time."

                However, RTI activist Lokesh Batra, points out another aspect.

                "Only if the Honourable High Court is convinced by the PIO that the delay was beyond his control for a certain period, then the Court is justified in reducing the penalty."

                "However, even if the penalty has been reduced, the High Court has held the PIO guilty of delay and thus upheld the CIC decision."
