Since other vacancies may also open up in coming months, I am, herewith, applying for the post of Chief Information Commissioner or Information Commissioner of the Maharashtra State Information Commission as and when the next set of appointments are made.

 

Section 15(5) of the Right to Information act says that “The State Chief Information Commissioner and State Information Commissioners shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance.”

 

I am an active campaigner for the cause of Right to Information, and am widely considered as an authority on the subject. I am regularly invited by various forums to give talks and conduct workshops on RTI and citizen empowerment. The formats that I have developed for proper implementation of RTI by public authorities and information commissions have been carried verbatim in the PriceWaterhouse Cooper report (2009), and representations drafted by me have resulted in pointwise instructions being put out by the Maharashtra Information Commission and subsequently, a number of GRs and circulars being issued by Maharashtra Government. My campaigning work and views are regularly featured in all the major national dailies across the nation.

 

I have enclosed my detailed resume along with this application. I request you to consider my candidature for the post of the Chief Information Commissioner of the Maharashtra State Information Commission and the post of Information Commissioner of the Maharashtra State Information Commission. Dear Leslie,
 
Are you posting a format of application. This need to have substantiating documents and applications may change from person to person. Just press reports of agitaions will not be suffuicient and showing only "against establishment" attitude, the application need to shown as sustainable inclusinve way of application. On whose instance the various circulars issued that needs to have substanciating documentation. You were all baiting Mr. Shailesh Gandhi earlier.

Frontline of a New War: Environmentalists Under threat

‘Amit Jethwa shot dead’ read the SMS received at about 9 pm on July
21st.. I did not know him personally, but I knew Amit,  activist, and
warrior for any ecological cause--be it the case of an elephant being
treated cruelly in a circus or illegal mining in Kodinar bordering Gir
or protesting against a shipyard that would impact the nesting of
olive ridley turtles. It was a sleepless night, and I spent most of it
trying to reconnect, build up history by going through old mails.
There were many over the years covering a myriad of causes, most
marked ‘URGENT’, most signed off with “Please do needful, and
highlight at national level.” One of the first issues he drew my
attention to was what he termed a ‘fictional’  report by the Gujarat
forest department that said ‘wildlife like Great Indian Bustards in
Gujarat is thriving (it’s not) and that Gujarat’s ecology is not in
danger(I wish).”   His detailed note contradicting such superficial
statements was well-researched. Nothing fazed him. He rallied against
the expansion of a cement factory bordering Barda sanctuary, which
also hosts the lion, brought to light smuggling of wood from Gir,
protested against encroachment on a wetland in Bhavnagar. He tired
hard to get suppressed evidence of Salman Khan and his colleagues’
alleged killing of Chinkara in Banni in Gujarat during the shoot of
Hum Dil De Chuke Sanam.

One of his major fights was limestone quarrying in a critical lion
corridor and its faulty, fraudulent  Environment Impact Assessment.
Amit’s campaign against illegal mining in Saurashtra was relentless.
And possibly, he paid for this with his life.

Amit  was among those rare beings who looked beyond their own narrow
world, and put the cause before their own self. He cared. With him,
environment and wildlife has lost a fierce protector.

Such incidents are common place in the Amazon, where the struggle to
save the tropical forests has claimed many victims. Here in India,
Amit’s tragic death highlights a dangerous trend of environmental
groups and activists increasingly under threat and victimized for
protesting against, and coming in the way of projects with grave
ecological consequences. Early July, a friend called with the news
that a young couple Kavita and Shiv Prasad from Syalna a village in
Pauri Garwal were beaten up and stoned for protesting against illegal
timber felling. Kavita almost lost the baby she was carrying. The
police was not interested in filing an FIR, the hospital was delaying
in issuing a medical report, and the couple needed some police
protection—the goons were still threatening them. Could I help, did I
know someone ‘higher-up’ to counter the influence of the timber lobby?
A few months back, Debi Goenka and his colleagues of Conservation
Action Trust were attacked by land sharks at Kandarpada-Dahisar in
Mumbai while they were surveying mangroves.  Conservationists Bittu
Sahgal and Shailendra Yashwant were sued when they opposed the setting
up of a pesticide plant by United Phosphorus in Vapi in  Gujarat.
Conservation scientist Dr Ullas Karanth and his colleagues who fought
mining in Kudremukh National Park suffered through a relentless
disinformation and slander campaign. The number of forest staff that’s
has been threatened and murdered by poachers and timber smugglers is
legion.  The list is endless, and such targeted persecution is a
worldwide phenomenon: I will only quote the brutal killing of two
environmental activists who opposed mining projects in the central
Cabañas (El Salvador) in December 2009. One of them, Dora Alicia
Recinos Sorto, was eight months pregnant when shot dead in front of
her two-year-old child, also wounded in the attack.

At equal risk are reporters who cover environment. So much so, that
Environment reporting  has been called the 'Front Line of a New War' .
  Reporters Sans Frontieres,  the Paris-based media watchdog has
published two consequent reports which state that exposing
deforestation, pollution and environmental damages may be dangerous in
many countries—including India--and has drawn attention to 13 cases of
journalists and bloggers who have gone missing (probably killed),
savagely assaulted, jailed, threatened or censored because they were
trying to turn the spotlight on  environment destruction.  For
instance, Bulgarian reporter Maria Nikolaeva was threatened with
having acid thrown in her face.

I know where that comes from. A colleague was nearly run over by
illegal miners in Goa, another faced dire consequences for exposing
illegal encroachment.  I have been threatened, detained and my driver
roughed up by miners and ivory traders have vented their ire.

Fact is:  the stakes in environment  are very  high  and in an unequal
society the fight to control fast depleting natural resources is
getting edgier throwing communities and big corporates into bitter
battle.  For long, the perpetrators got away. Now, when projects with
grave ecological consequences are questioned, those who uncover and
expose the inconvenient truth put their lives at risk.

Everything under the Earth and above the sky

 

The government order says all materials under the earth and above the sky belongs to Government. But it allows private bodies to use the sky for wireless connections and dig oil wells and take minerals from under the Earth.

Please let us know if these orders were changed and the Government can sell or lease out anything under the Earth and above the sky?

My Testimony as RTI volunter

 

I, Mr. Leslie Almeida age 58 yrs, retired merchant Navy Officer, do solemnly state

      I am  not running an NGO many of whom do not even audit accounts, there are scams  in some NGO’s like the one “DIGNITY FOUNDATION” who looted senior citizens as reported by the press. and I believe some are booked or may be in Police lockup.

1.      I have been active in RTI since 2003 helping out the late Kewal Semlani like a chokra boy at the RTI helpline of ST Andrews church Bandra, this fizzled out in the year 2004 because of some problem which I  wish not  to disclose.

2.      In the year 2006 some parishioners of ST Andrew’s Church Bandra approached me

To revive the RTI Help center, I agreed , on 6th October 2006 the RTI cell was revived,

Times of India reports St Andrews Church Joins RTI Crusade.

3.      Upto date the cell has been visited by over 1000 citizens, having a success rate of 60 percent. Which some help of my RTI colleges I learned some of my mistakes and got valuable help.  I do not wish to quote names.

4.      I had in my own capacity put over 500 RTI applications, 1st appeal, 2nd appeal

Although I received death threats, it did not deter me to go along my relentless work

Nor did I ask for any Police help, as the greatest offenders of RTI act are the Police force,

Having documentary proof of same.

5.      My 7 applications complains u/s 18 regarding Assessor & Collector charging Rs 230

For a A4 sixe page, Building proposal Department charging Rs 27 for A4 size page

And Rs 110 for plans,same as MSD Collectors office Bandra east, and other matters are gathering dust at SIC office Mumbai almost 3 years

6.      However when Mr. Baskar Prabhu takes up the matter with SIC about assessor and collector charging Rs 230 this year, SIC complies stating Rs 2 should be charged, this because Baskar Prabhu runs a NGO and is a chelae of SIC Suresh Joshi.immediately press reports same, Collars up for Baskar Prabhu (God)

7.      I wish to state that Shri Sailesh Gandhi used to send people to our RTI helpline

As he did not have time attending to citizens, he even send College students to out helpline for guidance for the project work, which we helped out to their satisfaction

8.       Although I got some guidance from Shri Sailesh Gandhi which I did appreciate, at every seminar he had he emphasized that the tooth of the Act is the penalty clause of Rs 250 per day for not parting  with information, today being a CIC does he practice what he preached???? If the answer if NO,  it means adopting double standards.

9.      I appreciate the work that many are doing to uphold the spirit of the RTI act,

10.  If lakhs of applications are pending at SIC/CIC office the reason is clear, SIC/CIC are soft peddling on PIO’s, not imposing penalties, even when orders are passed some PIO

do not comply their complains u/s 18 to SIC/CIC falls on deaf  ears.  

11.  If one RTI activist is murdered there are 10 that are born, there are many Citizens

Who do not tolerate injustice nor are they afraid of their lives. I cherish them for their fearlessness.

12.  When I was a young boy I saw a movie of late Amjad khan Sholay if I am not mistaken his dialogue inspires me even today, quote “JO DARA TOO MARA”  “traitor says Saab ape namak kaya hai Amjad says to him quote “ Abe Gole ka lo”

13.  I believe TOI reported St Andrew’s RTI helpline as the best helpline of Mumbai,

I do not take credit for it, it’s the Church who gets the credit.

There seems to be some misunderstanding. Normally the nations wealth belong to the people of India and Government is only a custodian. i.e. of there are valuable mineral deposits etc. that GSI is the custodian of these minerals, same in case of forest reserves, habitats etc. The Government has laid down guidelines on how these can be utilized by the people including commercial organizations.

In most cases, these organizations have to meet the formalities and apply for license after paying the prescribed fees etc. This includes the air waves.

Some times people create there own wordings to persons, thanks for the compliments. It is we took commitments from Shailesh publically in apublic meetingto clear atlleast 25 per day appeals or oterwise he should resign. He has maintained the the same and hearing to his depat alloted are within 60 days. Orders are given on the spot for 99.9 percent appeals. It is he who made his office digital. It is he who made the manual of process of work in his office. Gandhi has penalised highest in total tenure. It is he who spends from his pocket to some some of the staff that he has appointed to process appeals.We are not chelas of any one, but keep sustainable continuos pressure on the system to change we are happy about what we are doing and we are also happy that there are lot of chelas that are following us thanks to faith shown on us by these people. It is apprcialblle that you have done 500 appliocation and 60 percent sucess ratio it will good if you could make tabular record of these application, so that it can be refered.
 
We have also learnt to listen the critisism so that we as team get more stronger.
