*New Delhi **June 30: *The Centre's decision of not disclosing file notings
under the Right to Information Act has drawn criticism from the Central
Information Commission, which held that this amounted to violation of the
transparency law. Starting the debate all over again, the department of
personnel and training (DoPT) rejected that file notings were exempted under
the RTI Act. The commission said it meant "substituting the law". "The
circular of DoPT is curious in that it seeks to substitute the law passed by
Parliament with its own interpolation inserted in its website," chief
information commissioner Wajahat Habibullah said.

The circular was brought to the notice of the transparency panel during a
hearing on a complaint of retired IAS officer Des Raj Dhingra, alleging that
the DoPT had refused to provide him information relating to file noting on
his RTI plea. "What the DoPT would appear to wish to do by means of this
presumptuous circular is to substitute an opinion of an undersecretary for
the (earlier) decision of the commission," Mr Habibullah said. The
commission also pointed out that the government's decision of not disclosing
file notings under the RTI Act has been taken not on the basis of any expert
advice, but on the recommendation of an undersecretary.

PWD officials say they have knocked down walls, stripped wooden floors,
ordered new desks and plush sofas and television sets for senior ministers
like Bellary mine baron Karunakar Reddy, the new revenue minister and women
and child welfare minister, P.M. Narendra Swamy, running up bills to the
tune of Rs 1 crore for now.
Is there a budgetary limit on renovation? Surprise, surprise. There's none.
If vaastu requires it, the state government sets no boundaries. Except to
say that interior decoration must cost Rs 3 lakh for Cabinet ministers and

Hi all,

after repeated e-mails, letters, requests, group post......No one heared in Punjab State Information Commission.....

The request to change the court was not entertained and outcome is in line with the expectations.....

On 20-June-08, as expected, Sh. P.K. verma "disposed of" the complaint case of wider public interest.

As usual, he belived the concoted story of respondent and failed to have a look on the notification no. 696/RTI Cell dated 31-08-07 of Punjabi University, Patiala saying that "ਆਈ.ਪੀ.ਓ ਸਵੀਕਾਰ ਨਹੀ ਕੀਤੇ ਜਾਂਦੇ" .

This is highest degree of mockery of the laws meant for "governance, Transparency and accountability"

what to expect from others????? There are many other issues, but the Commission appears to be reluctant to do anything to implement RTI and their only intention is to harras the 'whister-blower"....what a fun of accountability????

It appears no one care to listen in the Punjab State Information Commission.

So, through this e-mail, all of you in media. government, NGO, social groups are requested to take up the matter in appropriate forum.

I wish to inform you that I have filed (in feb 2008) a Petition u/s 17 of RTI act before Hon'ble Governor of Punjab to remove Mr. P. K. Verma on various grounds.

This case may get affected due to the pending proceedings between the Complainant and Commissioner.

Mr. P.K. Verma may act revengefully.

The present case is in the wider Public Interest and need to be attended properly.

So, you are requested to change the court of hearing for CC855/2008 from the court of Sh. P.K. verma to any other court of commission.

You are also requested to stay all proceedings till the decision on this application.

It appears that Punjabi University adminstration thinks that they are ABOVE the Law.

TV Programme on Right to Information called "Fight for your Rights" will now also be available nationwide. This programme was available on NDTV Metro-Nation Delhi till now, but from this Saturday, this programme will go nationwide. Watch Fight for your Rights on NDTV India on Saturdays at 12:00 noon.

Fight for your Right is an hour long programme and it focuses on use of RTI Act to counter corruption. Tis saturday's programme will focus on the corruption in PDS in Bhalaswa area in Delhi. Mr Ansari, Information Commissioner, CIC and Mr Colin Gonsalves, Senior Advocate Supreme Court of India are at the panel. Arvind hosts this programme and is the anchor.

High court on Tuesday ruled that RTI Act would not cover Co-operative socities which were not funded by the state Government > While allowing a petetion filed by Datta Prasad Co-operative Housing Society Limited , The Court held that , State Cant seek information on the affairs of the socitity under Society Act 2005 . COURT HELD THAT THE RTI ACT WAS BROUGHT OUT WITHOUT PROPER DEBATE .The Petitioner Society would not come under the RTI Perview , Justice Dr K Baktavasala said in his order .

In a recent decesion, Shri Rash Behari Datta v/s All India Radio, the CIC has imposed maximum penalty on the CPIO of All India Radio Directorate General New Delhi for eight months delay in supply of information.

Nothing that over 240 days delay had taken place, the CIC was not satified by the reply to the show cause notice. The penalty order states "Commission has decided to impose a penalty of Rs.25,000/- for a delay of more than 100 days upon Shri S.P. Bhattacharya, the CPIO & Dy. Director, All India Radio, Akashwani Bhawan, Parliament Street, New Delhi-110001".

The debate on what is and what is not a Public Authority makes me sad.

To my mind, any organization claiming to work for the good of the
humanity/country should open itself up to public scrutiny. NyayaBhoomi is
one such organization, and our Governing Body has taken a decision on 05th
July 2008 to bring ourselves within the ambit of RTI Act, 2005 starting 15th
August 2008. Resolution No. 14 is reproduced below verbatim.

"RESOLVED that the Society shall come within the ambit of the Right to
Information Act, 2005 with effect from 15th August 2008 as if it is a public
authority and shall submit itself to the jurisdiction of the Central
Information Commission. The Secretary, Shri Rakesh Agarwal is hereby
appointed as the Public Information Officer and the President, Shri Uday
Gosain shall act as the First Appellate Authority. Shri Rakesh Agarwal shall
compile and publish all information under Section 4(1)(b) of the RTI Act,
2005 and will also ensure that all obligations on behalf of the Society are
discharged under the RTI Act, 2005."

Information under section 4(1)(b) shall be published on time. A copy of the
decision shall be sent to the CIC in mid-August. I hope we do not encounter
resistance there as we have, by a conscious decision, never taken any
government or institutional funds.

The Uttar Pradesh government Wednesday suspended state chief information commissioner M.A. Khan on charges of irregularities, sources said.

Khan's case has been referred to the Supreme Court of India, the sources added.

Uttar Pradesh chief information commissioner faces probe (Lead)

Lucknow, July 9 (IANS) Uttar Pradesh chief information commissioner Justice (retd) M.A. Khan was Wednesday debarred from performing his duties as Governor T.V. Rajeswar recommended to the Supreme Court to initiate an inquiry against him, officials said. Khan has been accused of misconduct and lack of capability to perform his duties, they added.

Following a complaint by a panel of social activists, he was prohibited to attend his office till the inquiry was over, the officials added.
