Read more closely. This case involved someone who copied from one format
to another AND THEN made the copy available to anyone else through a file
sharing format. Sharing copies of a copyright-protected work is the issue
in the case, not copies for personal listening.

The discussion of the legality of copying between formats for personal use
(and not then selling, sharing, or distributing) was discussed in a
totally hypothetical tangent. It appears the defendant was trying to argue
that if copying for personal use was legal, so is sharing the copy with
others (but that's from looking at a non-legal news source which is very
dubious)

IT IS UNFORTUNATE THAT MANY JOURNALISTS WRITE ABOUT LEGAL ISSUES ABOUT
WHICH THEY LACK ANY KNOWLEDGE.

Actually, the second link (to the Fox News story) includes text from the
supplemental brief (written by RIAA's lawyer):

"'It is undisputed that Defendant possessed unauthorized copies of
Plaintiffs' copyrighted sound recordings on his computer,' the brief
states. 'Virtually all of the sound recordings on Exhibit B are in the
'.mp3' format. ... Defendant admitted that he converted these sound
recordings from their original format to the .mp3 format for his and his
wife's use. ... Once Defendant converted Plaintiffs' recording into the
compressed .mp3 format and they are in his shared folder, they are no
longer the authorized copies distributed by Plaintiffs.'"

The excerpt above implies that, simply by converting the recordings from
one format to another, the user has violated copyright.  It was his
making the files available that attracted the attention of RIAA, yes,
but RIAA made it clear that possession of sound recordings in an
unauthorized format (i.e. a different format from that in which the
recordings were purchased) is a violation.

I'm with Winona, the OP, on this one.  This is a scary statement.

That's true, Aaron, this case is not primarily about format shifting, 
but it's extremely significant that the RIAA is now arguing that format 
shifting of legally purchased CDs is not fair use. They used to concede, 
presumably because they feared backlash, that such personal use copying 
was legitimate. It's important if they've changed their minds, because 
the RIAA is very good at getting its policy preferences enshrined in 
law. But I would take issue with Winona's phrasing "Apparently it's 
illegal"; the RIAA saying it doesn't make it so, thank goodness.

You are reading out of context. If the defendant hadn't put them on a
computer that was "sharable" there wouldn't be an issue. 

When they sue someone for copying via a computer that is not used to
share files, then you can worry (actually, the guy who hires the lawyer
who makes the argument will worry about being fined for bringing a
frivilous lawsuit or at worst one where damages are the difference in
price between the two formats when purchased for a single personal use).

"Internet" news is about as significant as "urban myths", and librarians
need to be a bit more critical.
